Terms of Service

1. Provider

FoxApi.dev is operated by Jannes Korn, Höhenweg 13, 88709 Hagnau am Bodensee, Germany (hereinafter "we", "us", or "FoxApi.dev"). You can reach us at legal@foxapi.dev.

2. Scope and Acceptance

By registering for or using FoxApi.dev (the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. These Terms apply to all users, including free and paid plan subscribers.

3. Description of Service

FoxApi.dev provides a REST API that returns fox images. Users access the API via API keys generated in their dashboard. The Service is provided over the internet and requires a stable connection.

4. API Keys and Account Security

You are responsible for keeping your API keys confidential. You must not share keys publicly or embed them in client-side code that is accessible to end users. You are liable for all usage occurring under your API key. If you suspect unauthorized use, revoke the key immediately from your dashboard and notify us at legal@foxapi.dev.

5. Plans and Rate Limits

• Free Plan: 100 requests per month
• Pro Plan: 10,000 requests per month
• Enterprise Plan: Unlimited requests

Exceeding your monthly limit will result in your API key returning an error until the next billing cycle. We reserve the right to adjust rate limits with 30 days' notice.

6. Payments and Billing

Paid plans are billed in advance on a monthly or annual basis via Stripe. By subscribing you authorise us to charge your payment method for the applicable fees. All prices are shown in EUR and exclude any applicable taxes (e.g. VAT) unless stated otherwise.

We offer a 30-day money-back guarantee for all paid plans. If you are not satisfied within 30 days of your first payment, contact us for a full refund. After this period, fees are non-refundable except where required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Price changes will be communicated with at least 30 days' notice.

7. Acceptable Use

You may not use the Service to:

• Violate any applicable law or regulation.
• Transmit malware, viruses, or any harmful code.
• Interfere with or disrupt the Service or its infrastructure.
• Scrape or bulk-download images beyond normal API usage patterns.
• Impersonate FoxApi.dev or any other person or entity.
• Resell or sublicense the API as a standalone product without our written consent.

We reserve the right to suspend or terminate access to accounts that violate these rules without prior notice.

8. Intellectual Property

All fox images served via the API are provided under their respective licenses. FoxApi.dev does not transfer ownership of images to you. You may use images in your applications in accordance with the image's original license terms. If you are unsure about permitted uses, contact us before publishing.

9. Availability and Warranties

We aim for high availability but cannot guarantee uninterrupted access. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or merchantability.

10. Limitation of Liability

To the fullest extent permitted by applicable law, FoxApi.dev shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Service. Our total aggregate liability shall not exceed the amounts paid by you in the 12 months preceding the event giving rise to the claim.

11. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access immediately if you breach these Terms or if we reasonably believe continued access poses a security or legal risk. Upon termination, your API keys are revoked and your data will be handled in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by e-mail or a notice in the dashboard at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by German law (excluding conflict-of-law rules). The place of jurisdiction for any disputes, to the extent legally permissible, is the registered address of Jannes Korn in Germany. For consumers within the EU, mandatory consumer protection provisions of your country of residence remain unaffected.
